These Terms of Use ("Terms") govern your access to and use of the website located at homefield.so and its content (the "Site"), operated by Homefield Labs Inc., a Delaware corporation ("Homefield," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Scope. These Terms govern use of the Site only. Access to and use of the Homefield platform and services is governed by a separate written agreement between Homefield and the customer. In the event of a conflict, that agreement controls with respect to the platform and services.

Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable right to access and view the Site for your own informational and business purposes.

Restrictions

You may not:

  • Use the Site in violation of any applicable law or regulation
  • Access the Site by automated means, including scraping, crawling, or harvesting, except by well-behaved search engine crawlers that respect our robots.txt
  • Attempt to gain unauthorized access to the Site, its servers, or any related systems or networks
  • Probe, scan, or test the vulnerability of the Site, or circumvent any security or authentication measure, except as expressly permitted under our responsible disclosure practices
  • Interfere with or disrupt the integrity or performance of the Site

  • Use any Homefield trademark, logo, or brand feature without our prior written permission

Intellectual Property

The Site and all content, features, and functionality on it — including text, graphics, logos, images, and software — are owned by Homefield or its licensors and are protected by intellectual property laws. Except for the limited right granted above, no rights are granted to you.

Third-Party Links

The Site may contain links to third-party websites and resources. We provide these links for convenience only. We do not control, endorse, or assume responsibility for third-party content, products, or practices, and your use of any third-party site is at your own risk and subject to that site's terms.

Submissions and Feedback

If you submit ideas, suggestions, or feedback to us through the Site, you grant Homefield an unrestricted, royalty-free, perpetual right to use them for any purpose without obligation or compensation to you. Do not submit confidential information through the Site.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEFIELD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

Indemnification

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
